Illinois Biometrics Privacy Suits Bring Insurance Questions

Law360, New York (November 16, 2017, 4:05 PM EST) -- In the past two years, we witnessed a wave of putative class action lawsuits filed under Illinois’ Biometric Information Privacy Act (“BIPA”) (740 ILCS 14/1 et seq.), with the rate of filings increasing exponentially in the past few months. The epicenter of these filings has been Chicago, Illinois, home of the plaintiff-friendly Circuit Court of Cook County and the larger division of the United States District Court for the Northern District of Illinois, where dozens of these suits are now being litigated.
