Bronx Co-Op Tells Judge To Nix Suit Over FLSA Violations

Law360, New York (January 28, 2014, 3:10 PM EST) -- The owners and operators of Co-Op City, a housing cooperative in the Bronx that includes 35 buildings and seven townhouse clusters, asked a New York federal judge on Monday to toss a suit claiming they improperly penalized hourly employees by configuring time clocks to round down and failed to pay them for all hours worked.

The plaintiffs, a group of current and former hourly paid employees of property manager Riverbay Corp., filed an amended complaint in December, adding the company's director of finance, Peter Merola, as an individual defendant, claiming his management position gave him power over the company's wage policies....
