Health Insurer Ordered To Alter Payment Notice Process

Law360, Washington (March 28, 2014, 5:59 PM EDT) -- An Illinois federal judge on Friday ruled in favor of chiropractors accusing Independence Blue Cross of clawing back payments in violation of the Employee Retirement Income Security Act, ordering IBC to modify its payment denial notice and appeal procedures.

Following a December trial, U.S. District Judge Matthew F. Kennelly said IBC retroactively denied benefits for purportedly overpaid medical services without affording members Pennsylvania Chiropractic Association and others of their notice and appeal rights under ERISA.
