Ky. State-Hired Nonprofit Not Immune In Transit Injury Suit

Law360 (May 10, 2019, 7:11 PM EDT) -- A Kentucky appellate court on Friday rebuffed a nonprofit subcontractor's bid to beat a personal injury lawsuit by claiming governmental immunity, reasoning that the Medicare patient transportation company is clearly not a government entity.

A three-judge Kentucky Court of Appeals panel upheld a trial court ruling that rejected Federated Transportation Services of the Bluegrass Inc.'s bid for summary judgment in the suit, which alleges a driver for the medical transportation company failed to properly strap Peggy Walling in, causing her to fall and sustain "serious and permanent injuries."
