7th Circ. Cancels En Banc Rehearing In Sanctuary City Case
Law360 (August 13, 2018, 9:37 PM EDT) -- The Seventh Circuit on Friday canceled a planned full-court rehearing in the Trump administration's appeal of a preliminary nationwide injunction preventing it from imposing conditions on federal grants targeting sanctuary cities, saying it no longer had jurisdiction.
The city of Chicago had argued in late July that the government's appeal should be dismissed as moot due to the district court's decision to enter a permanent injunction in the case barring the administration from enforcing the grant conditions. The appeals court agreed on Friday, finding that the preliminary injunction is now meaningless and the appeals process must restart.
