Ex-Domino's Worker Urges High Court To Take Venue Fight

Law360 (January 5, 2021, 7:41 PM EST) -- A former Domino's Pizza worker has urged the U.S. Supreme Court to take on his case over who decides whether a dispute must be arbitrated, a court or an arbitrator, saying unanimous courts of appeals lack analysis in their opinions and run contrary to high court precedents.

Former delivery driver Derek Piersing on Monday slammed Domino's Pizza Franchising LLC's argument against his petition seeking high court review of workers' fight against the pizza chain. Domino's in a recent brief argued that arbitrators should be able to decide the scope of their own powers and thus resolve gateway questions of arbitrability....
