It also is in a state of flux. Further significant changes appear inevitable, as calls for change persist. The new director of the USPTO, Andrei Iancu, has voiced openness to PTAB reform, while the PTAB faces increased scrutiny from the Federal Circuit, association and industry activism, and Congress, and prospective admonishments from the U.S. Supreme Court in its forthcoming Oil States[1] or SAS[2] decisions....
