Justices Won't Hear Art Resale Case Against Sotheby's, EBay

Law360 (April 1, 2019, 3:15 PM EDT) -- The U.S. Supreme Court on Monday refused to hear a failed case that had aimed to force Christie’s, Sotheby’s and eBay to pay royalties under California’s unique art resale law, leaving in place a ruling that ordered the artists who filed the case to pay the legal bills of two of the auction giants.

By denying certiorari, the justices declined to wade into a long-running case — filed more than eight years ago — that sought to enforce California’s Resale Royalty Act, which requires resellers of fine art to pay a 5 percent royalty to the original artists.
