Tech Co. Won't Get Costs Following Arbitrator DQ Bid
Law360 (May 21, 2020, 10:32 PM EDT) -- A London judge refused on Thursday to order an arbitrator and a nonprofit children's organization to pay costs incurred by an app developer during its bid to remove the arbitrator — who later resigned — saying the app developer couldn't be considered the successful party.
Judge Andrew Henshaw concluded that it wasn't the challenge lodged before him by the app developer, identified in the judgment only as C Ltd., that had led to the arbitrator, identified only as "X," to resign from the proceeding. As such, the developer hadn't succeeded in its court challenge and therefore was not eligible to recoup the costs incurred during the challenge....
