States, Schools Line Up Against PTAB's Immunity Waiver

Law360 (June 12, 2018, 5:58 PM EDT) -- States and public universities have urged the Federal Circuit to overturn a decision finding the University of Minnesota exposed its patents to challenge at the U.S. Patent Trial and Appeal Board when it filed infringement lawsuits in district court, a decision the schools said could harm innovation. 

Indiana led a group of more than a dozen states that signed onto an amicus brief filed last week. They argued that requiring the university to defend its patents at the PTAB was an “invasion” of state sovereignty....
