Horse Race Cos. Say Machines At Kentucky Downs Rip Off IP

Law360, New York (October 8, 2015, 5:41 PM EDT) -- The owners of a group of horse racing companies slapped rival venue Kentucky Downs and gambling technology company Encore Gaming with a trademark infringement lawsuit in Kentucky federal court Wednesday, claiming that their marks are illegally displayed by a video-based gaming system.

Churchill Downs Inc., Oaklawn Jockey Club Inc., New York Racing Association Inc. and other horse racing track owners said that the Encore Gaming Instant Racing system, made by Encore Gaming LLC and used by Kentucky Downs LLC, allows gamblers to bet on video replays of races at the plaintiffs' tracks. Those videos allegedly include the plaintiffs' trademarks without authorization....
