Subway, T-Mobile Text Offer Violated TCPA, Consumers Say

Law360, New York (September 7, 2016, 3:55 PM EDT) -- Subway Sandwich Shops Inc. and T-Mobile USA Inc. were sued Tuesday by consumers who say a joint promotion for chicken sandwiches included sending mass unwanted text messages to T-Mobile customers' phones last Thursday.

Two consumers moved quickly to file a Telephone Consumer Protection Act class action after allegedly receiving the same text on Sept. 1. It purportedly said: "This T-Mobile Tuesday, Score a free 6'' Oven Roasted Chicken sub at SUBWAY, just for being w/ T-Mobile," and included a link to an app that would provide more details.
