Judge Orders Redo In First AbbVie Testosterone MDL Trial

Law360 (February 26, 2018, 4:44 PM EST) -- An Illinois federal judge has ordered a new trial in the first bellwether against AbbVie Inc. in the multidistrict litigation over testosterone replacement therapy products after finding that the jury likely misunderstood the issue of causation.

After reconsidering an earlier decision to order a new trial on just one of plaintiff Jesse Mitchell's claims, U.S. District Judge Matthew Kennelly on Saturday said that he wants the whole of Mitchell's case retried next month. The jury's verdict on Mitchell's three claims, handed down in July, was inconsistent and must be thrown out, Judge Kennelly said.
