NexGen Patient Presses Zimmer In 1st MDL Test Trial

Law360, Chicago (October 15, 2015, 7:17 PM EDT) -- Medical device manufacturer Zimmer is facing its first bellwether test in sprawling multidistrict litigation challenging the reliability of its NexGen knee implant, with a doctor taking the stand in an Illinois federal court Thursday to allege the device failed a patient twice.

On the third day of the jury trial that could determine the future course of the MDL, bellwether plaintiff Kathy Batty's attorneys called upon Dr. Joseph Fetto of NYU's Langone Medical Center to testify about the damage caused to both of Batty's knees after her NexGen implant came loose.
