Homeowners In Chubb Row Ask 2nd Circ. For Class Cert.

Law360, New York (August 20, 2013, 6:03 PM EDT) -- Insurance policyholders who claim a Chubb Corp. subsidiary unfairly hiked home insurance rates asked the Second Circuit on Tuesday to reverse a decision that denied them class certification, arguing the case is simple enough to proceed as a class action.

Chubb unit Great Northern Insurance Co.’s use of common, formulaic insurance policies means an action challenging price increases could easily proceed as a class action, a lawyer for policyholders in two related suits told a panel of judges at oral arguments in Manhattan.
