Costco Fax Recipients Get Class Cert. In TCPA Suit

By Steven Trader (April 28, 2017, 2:57 PM EDT) -- A group of people and companies led by a law firm accusing Costco of sending unauthorized faxes in violation of the Telephone Consumer Protection Act can proceed on their claims as a class, after a Missouri federal judge Thursday found the issue to be common and the class members ascertainable.

U.S. District Judge Stephen Bough granted The Backer Law Firm LLC's request to represent a class of about 1,550 individuals and entities who allegedly received unsolicited Costco junk faxes purportedly lacking the opt-out language required by the TCPA from April 2011 to April 2015.
