Fitbit Urges Judge To Force Arbitration In Heart Monitor Row

Law360, New York (January 10, 2017, 4:30 PM EST) -- Fitbit Inc. asked a California federal judge on Monday to compel arbitration in a proposed class action accusing the company of making “wildly inaccurate” fitness trackers, arguing that the consumers have had a year for discovery and that the case must now go before an arbitrator.

According to an opposition brief filed in concert with the company’s motion to compel on Monday, the consumers have not provided any evidence disputing the validity of the arbitration clause. The clause was included in the company’s terms of service,...
