Airline Can't Bring Security Co. Into Passenger Injury Suit

Law360 (June 13, 2018, 7:25 PM EDT) -- An airline being sued by a disabled woman who says she was injured when its employees helped her board the plane via a “rescue chair” cannot bring on as a third-party defendant a company that provided on-the-ground support services because neither company can find their signed contract, a federal judge has ruled.

U.S. District Magistrate Judge Andrew W. Austin found that a claim of breach of contract — much less negligence — cannot be sustained when the contract itself can’t be located.
