Justices Wipe Out Climate Suit Venue Rulings From 3 Circuits

Law360 (May 24, 2021, 1:27 PM EDT) -- The U.S. Supreme Court on Monday vacated and remanded a handful of circuit court rulings that sent climate change tort claims against fossil fuel companies to state court, a week after ruling that appellate courts must expand their review of remand orders.

The First, Ninth and Tenth circuits must now redo their reviews of lower court orders remanding to state court suits lodged by state and local governments seeking to put Chevron Corp., ExxonMobil Corp. and other companies on the hook for climate-related infrastructure damages.
