Law360 (January 29, 2019, 6:15 PM EST) -- The Fifth Circuit held Monday that a Texas federal court was right to toss a False Claims Act suit accusing Rolls-Royce of billing the U.S. Air Force for uncertified parts, agreeing that the relator was barred from bringing the claims again after pursuing them unsuccessfully in earlier litigation.
The three-judge panel affirmed the dismissal of whistleblower George Gage’s litigation alleging that Rolls-Royce North America Inc. and Rolls-Royce Deutschland Ltd. & Co. KG submitted false claims for improperly sourced parts, concluding in an unpublished decision that he can’t try to relitigate failed allegations by swapping in new defendants.
