Calif. Vioxx Users Denied Class Status

Law360, New York (May 8, 2009, 12:00 AM EDT) -- A California state judge has denied class certification to plaintiffs seeking to recover purchase costs from Merck & Co. for its withdrawn prescription painkiller Vioxx, ruling there are no claims common to all class members.

Finding the plaintiffs were not typical, Judge Victoria G. Chaney tossed the motion for certification in an April 30 ruling in the Superior Court of California released by Merck on Friday.
