RadioShack Workers Seek Class Cert. In ERISA Suit

Law360, New York (May 18, 2009, 12:00 AM EDT) -- RadioShack Corp. 401(k) plan members have moved to certify a class that could include up to 13,000 employees, in a multidistrict lawsuit that accuses the company of breaching its fiduciary duty by allowing plan members to invest in an underperforming, scandal-tainted mutual fund.

In a motion filed Friday with the U.S. District Court for the Northern District of Texas, investors in the company's 401(k) plan ask the court to certify a class of 401(k) participants who invested in any Putnam Management fund since May 14, 2001....
