Litigation Funder Tries To Recover Advance To NFL Player

Law360 (May 8, 2018, 9:47 PM EDT) -- A third-party claims funder asked a Pennsylvania federal court on Tuesday to allow arbitration proceedings against a former National Football League player who is refusing to repay an advance of a portion of his potential recovery from an uncapped settlement in multidistrict litigation over brain injuries.

Thrivest Specialty Funding LLC's letter was sent a day before U.S. District Judge Anita B. Brody is scheduled to decide whether to permanently block the arbitration, since the original agreement arguably resembles a type of deal the judge barred in December that allowed players to be paid up front by assigning claims to third-party litigation funders. ...
