Pepsi Can't Stop Conn. Ad Agency's Super Bowl Suit

Law360 (June 5, 2018, 6:37 PM EDT) -- Pepsi lost its bid to dismiss a Connecticut advertising agency's claim that it stole a pitch for a Super Bowl ad when a New York federal judge on Monday ruled the latter sufficiently showed the soda giant should have at least negotiated its use of the idea.

PepsiCo Inc. signed a three-year preliminary agreement in 2014 with Betty Inc., which the advertising agency had plausibly alleged obligated the two companies to negotiate in good faith before Pepsi allegedly had another agency produce Betty's idea, U.S. District Judge Vincent L.
