CRT Purchasers Defend $6M Carveout For Excluded Buyers

Law360 (October 23, 2018, 6:30 PM EDT) -- A class of indirect purchasers of cathode ray tubes defended its bid to award $6 million of a $577 million bundle of antitrust settlements to buyers from three states who were excluded, saying Monday that the objectors' attempts to claim more money are based on an unrealistic analysis.

The objectors' claim that the damages owed to buyers from Massachusetts, New Hampshire and Missouri are worth $286 million is unrealistic because it assumes all of the damages could be recovered and does not take into account statute of limitation laws in Massachusetts and Missouri, the purchasers said in a reply brief....
