Liberty Mutual Counterclaim Tossed In Texas Hotel Row

Law360 (November 6, 2018, 9:35 PM EST) -- A Texas federal judge on Monday dismissed a Liberty Mutual Insurance Co. counterclaim from Hunt Construction Group’s suit over allegedly shoddy construction work on an Austin, Texas, hotel project and a related denied request for reimbursement under a performance bond.

U.S. District Judge Lee Yeakel adopted a magistrate judge’s recommendation from mid-October that Liberty Mutual’s breach of contract counterclaim against Hunt be dismissed for failure to state a claim. According to Judge Yeakel’s decision, no objections to the recommendation were filed.
