BofA Workers Cite 9th Circ., Win Cert. In Reversal Of OT Suit

Law360 (March 11, 2019, 11:36 PM EDT) -- A group of Bank of America mortgage lenders who alleged they were wrongly denied overtime won conditional certification to pursue a class action against the financial giant, when a California federal judge on Friday backtracked on an earlier ruling in light of a recent Ninth Circuit appellate decision.

U.S. District Judge Michael Fitzgerald said in Friday's filing that the plaintiffs had convinced him to reverse his earlier decision denying them conditional class certification.
