2nd Circ. Gives Madonna Songwriter Hope In Warner Suit

Law360, New York (March 26, 2019, 8:00 PM EDT) -- The co-writer behind Madonna's hit song "Vogue" appeared to have allies in the Second Circuit as he pressed Tuesday to recoup about $500,000 of royalties withheld from him by Warner Music Group to fund California copyright litigation.

Robert "Shep" Pettibone is appealing a decision by former Manhattan U.S. District Judge Richard J. Sullivan that said Warner unit WB Music Corp. was in the right under their copyright administration contract when it withheld royalties to fund litigation in California over whether “Vogue” infringed other copyrights.
