Law360 (April 8, 2019, 6:10 PM EDT) -- The Ninth Circuit has refused to rehear its decision to affirm an $8 million award to Bio-Rad Laboratories Inc.’s former general counsel in his whistleblower retaliation suit, denying the company’s request Monday in a brief order.
In its petition for a rehearing, the life sciences products manufacturer argued that the panel had overlooked important parts of the record in its affirmation in February. Bio-Rad said the panel’s reasoning was based on a legal theory that was not presented to the jury that runs in opposition to decisions by at least four other circuits.
