Marvel Beats Copyright Suit Over 'Iron Man 3' Movie Poster

By Bill Donahue (July 15, 2019, 9:43 PM EDT) -- A Manhattan federal judge on Monday tossed out a lawsuit claiming Walt Disney's Marvel Entertainment ripped off the design of an "Iron Man 3" movie poster from an earlier comic book, ruling there was no proof that the studio had ever seen the comic.

U.S. District Judge J. Paul Oetken ruled that Horizon Comics had failed to show that any of the designers at Marvel who worked on the poster had "access" to a 2001 comic called "Radix" — a crucial element in proving copyright infringement.
