Cox’s CDK Auto Data Deal Off-Limits In Antitrust Row

Law360 (August 19, 2019, 5:38 PM EDT) -- The confidentiality of the settlement between CDK Global and Cox Automotive outweighs any potential value its terms might have in sprawling antitrust litigation where car dealers continue to say CDK and a rival monopolized the market for crucial auto dealer data, an Illinois federal judge ruled Friday.   

Magistrate Judge Jeffrey T. Gilbert rejected a bid by dealership class plaintiffs, or DCPs, to order CDK to fork over the deal resolving both the antitrust claims leveled by Cox Enterprises' auto arm and other subsidiaries — including Autotrader.com and Kelley Bluebook — and CDK's counterclaims that Cox misused its data.
