Intel Case, DOL Rule Could Build ERISA Shield For Employers

Law360 (December 3, 2019, 11:09 PM EST) -- If matters go employers’ way at the U.S. Supreme Court and U.S. Department of Labor over the next few months, businesses will be able to cut workers’ deadline for filing ERISA class actions in half simply by sending an email.

Workers’ advocates say the one-two punch of an employer-friendly ruling in Intel Corp. Investment Policy Committee v. Christopher Sulyma, which will be argued before the high court Wednesday, and the passage of the DOL’s electronic disclosure rule would make it much harder for workers to sue over retirement plan mismanagement, infringing on their rights under the Employee Retirement Income Security Act....
