Masa Servers Win Cert. In Tip Pool Suit

Law360, New York (September 24, 2009, 6:31 PM EDT) -- Servers at the upscale Manhattan sushi eatery Masa have won class certification in a lawsuit accusing the Michelin three-star-rated restaurant of misappropriating tips.

Judge Edward Lehner of the New York County Supreme Court granted class certification with a settling order at a Sept. 17 hearing in Manhattan.

According to plaintiffs’ attorney Denise Schulman of Joseph Herzfeld Hester & Kirschenbaum LLP, which has several wage-and-hour suits against a number of high-end New York City restaurants, including Japonais, Nobu and Le Cirque, the class will include all servers...
