AA, Retirees Must Clarify Benefits Calculations In ERISA Suit

Law360 (May 11, 2020, 5:22 PM EDT) -- A Texas federal judge has ordered American Airlines retirees to show how the Employee Retirement Income Security Act allows for two different benefits calculation methods in a single pension plan, saying he needs more information to rule on their bid for class certification.

In an order filed Friday, U.S. Judge Reed O'Connor asked American Airlines and the pensioners to submit additional briefs to support their opposite understandings of how ERISA mandates benefit calculations in pension plans, as both parties failed to point to relevant ERISA provisions in their arguments over granting class certification to thousands of pensioners.
