Fed. Circ. Overrides WDTX Transfer Loss For Adobe, Dropbox

Law360 (July 28, 2020, 7:20 PM EDT) -- U.S. District Judge Alan D. Albright abused his discretion when he refused to transfer patent infringement litigation against Adobe to California, the Federal Circuit said Monday, before also granting Dropbox another chance to prove that litigation it's facing should likewise be transferred out of Texas.

A three-judge panel granted Adobe Inc.'s mandamus request, saying the Western District of Texas judge made several errors when denying the company's transfer request. Then, since Judge Albright had relied on Adobe's case to deny Dropbox Inc.'s transfer bid, the Federal Circuit ordered a do-over.
