Obama Administration Backs Revival Of Vioxx Case

Law360, New York (October 26, 2009, 8:01 PM EDT) -- The Obama administration reportedly has thrown its weight behind a group of investors who are seeking to ward off Merck & Co.’s appeal of a decision that reinstated a securities class action alleging it concealed the health risks of its recalled painkiller Vioxx.

On Monday, U.S. Solicitor General Elena Kagan filed an amicus brief with the U.S. Supreme Court challenging Merck’s assertion that the investor suits were brought too late, according to Dow Jones.
