Juniper Loses Bid To Halt Backdating Deposition

Law360, New York (December 9, 2009, 6:43 PM EST) -- In the ongoing class action over stock options backdating at Juniper Networks Inc., a judge has ruled that statements made by Juniper's stock options manager to a company audit committee investigating the matter are not subject to attorney-client privilege.

Judge Patricia V. Trumbull issued the ruling Wednesday in the U.S. District Court for the Northern District of California, saying that even if privilege existed, the audit committee's disclosure of the information to a third party — in this case, outside auditors — waived the privilege....
