Texas Panel Won't Revive Kinder Morgan Pipeline Siting Fight

Law360 (May 21, 2021, 6:02 PM EDT) -- A Texas appellate court said challengers of Kinder Morgan's completed $2 billion Permian Highway Pipeline can't sue over the lack of a pipeline routing rule, affirming the dismissal of their claims that state regulators abdicated their responsibility to maintain oversight of private natural gas pipeline placement. 

The three-justice panel of the Third Court of Appeals in Austin upheld the trial court's decision to toss a suit lodged by landowners and governments of Hays County and Kyle, Texas.
