AT&T, T-Mobile Win Bid To Nix Sales Tax Class Action

Law360, New York (December 15, 2009, 5:58 PM EST) -- T-Mobile USA Inc., Verizon Wireless LLC, AT&T Mobility LLC and several other wireless cell phone providers have won their bid for dismissal of a putative class action that claimed they deceived customers by charging sales tax on the full retail value of cell phones that were advertised as free or substantially discounted.

Judge Dana M. Sabraw threw out the case on Monday in the U.S. District Court for the Southern District of California when she granted individual motions for summary judgment filed by the defendants. She...
