The next phase of climate tort litigation against fossil fuel companies — in effect a replay of the previous phase — is coming after the U.S. Supreme Court directed appellate courts to redo their reviews of a key procedural battle. Meanwhile, the justices are mulling a petition urging them to clarify the U.S. Environmental Protection Agency's ability to craft climate regulations.
