Fed. Circ. Sends Nintendo Wii Patent Case To Wash.

Law360, New York (December 18, 2009, 2:34 PM EST) -- A federal appeals court has overturned a district judge's denial of Nintendo Co. Ltd.'s bid to move its Wii controller motion sensor patent dispute with Motiva LLC from Texas to Washington, saying the district court clearly abused its discretion in denying Nintendo’s motion.

A three-judge panel in the U.S. Court of Appeals for the Federal Circuit granted Nintendo's petition for a writ of mandamus vacating the U.S. District Court for the Eastern District of Texas's June order denying Nintendo’s motion to transfer venue.
