Awaiting A National Standard For 'Place Of Business'

Law360, New York (December 22, 2009, 1:44 PM EST) -- On Nov. 10, 2009, the United States Supreme Court heard oral argument in Hertz Corp. v. Friend, 08-1107, to resolve the question of where a corporation’s “principal place of business” is located for purposes of applying diversity jurisdiction under Section 1332 of Title 28.

Section 1332(c)(1) provides, in pertinent part, that “a corporation shall be deemed to be a citizen of any state by which it has been incorporated and of the state where it has its principal place of business ...”
