Tort Claims Survive In Chinese Drywall MDL

Law360, New York (January 15, 2010, 10:25 AM EST) -- A federal judge has refused to limit claims against manufacturers and distributors of allegedly defective Chinese drywall for economic damage, holding that several states’ economic loss rules do not hinder homeowners in the multidistrict litigation from pursuing tort claims.

On Wednesday, Judge Eldon E. Fallon of the U.S. District Court for the Eastern District of Louisiana denied defendants’ attempt to dismiss or strike tort claims for economic damages, concluding that the homeowners' claims are not restricted under the laws of Florida, Alabama, Mississippi and Louisiana....
