Indie Rockers’ Suit Over Rolling Stone Ad Not A Hit

Law360, New York (January 29, 2010, 2:42 PM EST) -- A California appeals court has pulled the plug on a class action indie rock bands Xiu Xiu and F****d Up filed against Rolling Stone magazine and R.J. Reynolds Tobacco Co. over a Camel cigarette ad the rockers say blurred the lines between advertising and a feature on the bands.

The California Court of Appeal for the First Appellate District on Thursday reversed a lower court ruling keeping the case alive, saying constitutional principles of freedom of speech and the press require that the lawsuit be dismissed....
