Staples Settles Assistant Manager OT Suits For $42M

Law360, New York (January 29, 2010, 4:12 PM EST) -- Staples Inc. agreed Friday to pay $42 million as part of a global settlement resolving several wage-and-hour collective actions claiming the office supply vendor misclassified its assistant store managers as exempt from federal overtime pay requirements.

That sum will include the $5 million in compensatory and liquidated damages a jury awarded 343 plaintiffs in February 2009 in a Fair Labor Standards Act case in the U.S. District Court for the District of New Jersey, the company said Friday. The $42 million also includes interest on that...
