Mark Holders Seek Cert. In Google AdWords Suits

Law360, New York (September 20, 2010, 4:02 PM EDT) -- Plaintiffs in a pair of suits challenging Google Inc.'s AdWords program have moved for certification of both nationwide and Texas-only classes of trademark holders who say Google violated the Lanham Act by selling their trademarks to competitors.

Lead plaintiffs FPX LLC and John Beck Amazing Profits LLC filed nearly identical motions Friday in separate cases in the U.S. District Court for the Eastern District of Texas, seeking certification on grounds that Google's controversial advertising policy affects all class members equally.
