Western Titanium Can't Toss US Attys In Fraud Trial

Law360, New York (October 6, 2010, 7:23 PM EDT) -- A federal judge refused Wednesday to disqualify prosecutors who Western Titanium Inc. says used privileged documents to construct a criminal fraud case alleging the company peddled low-grade titanium for fighter jets.

Judge Janis Sammartino of the U.S. District Court for the Southern District of California denied Western Titanium’s attempt to upend the case and disqualify prosecutors who it says mined documents that were actually off-limits.
