Antitrust Claim Survives 2nd Cut in Webkinz MDL

Law360, New York (October 21, 2010, 4:06 PM EDT) -- A federal judge has refused to dismiss for the second time an antitrust claim in multidistrict litigation alleging that Ganz Inc., supplier of the popular Webkinz toys, required retailers to buy unrelated gifts in order to obtain the plush animals.

In an order Wednesday, Judge Richard Seeborg of the U.S. District Court for the Northern District of California denied Ganz's motion to dismiss the claim, ruling that the plaintiffs had sufficiently argued in their second amended complaint that Ganz had caused competitive harm by tying Webkinz...
