Consumers Fail To Revive ATM Fee Antitrust Suit

Law360, New York (November 30, 2010, 5:59 PM EST) -- A federal judge has refused to backtrack on his determination that a putative class of bank customers lacks standing to maintain a suit accusing Bank of America NA, Citibank NA and several other banks in First Data Corp.'s electronic payment network of conspiring to fix ATM interchange fees.

Judge Charles Breyer of the U.S. District Court for the Northern District of California denied the plaintiffs' motion to vacate judgment on Monday, letting his Sept. 16 summary judgment order dismissing the case in its entirety stand....
