Philip Morris Does Not Have To Fund CT Scans: Judge

Law360, New York (January 13, 2011, 6:37 PM EST) -- A federal judge Thursday dismissed a proposed class action seeking to force Philip Morris USA Inc. to establish a medical monitoring program for New York smokers with a history of smoking Marlboro cigarettes.

Judge Carol Bagley Amon of the U.S. District Court for the Eastern District of New York issued an order dismissing a medical monitoring claim and granting Philip Morris summary judgment on a claim for breach of implied warranty.
